What is the average cost and time involved in pursuing a claim through the small claims court?

Generally the only costs you will incur will be the court fee (see the court fees section on this site). Some cases may call for expert evidence. The cost of an expert report will vary from discipline from discipline. You should always strive to keep these costs to a minimum as you may not be able to recover the full amount even if you win!

The length of the case is also dependant on specific factors such as whether the case is defended and how complex the issues are. There are regional variations too, with County Courts in some areas being faster than others. In general you should expect the process to take about 3 months or so: but we do know of cases that take much, much longer!
